Republic Reform Act of 2005
The Republic Reform Act of 2005 was a restructuring of the People's Republic of the Pacific, instituted on September 21, 2005.[1] The Republic Reform Act of 2005 governed the PRP until its dissolution in April 2006.
Preamble
On this, the two year anniversary of the NPO and the one year anniversary of the People’s Republic, the Senate and Assembly of Governors, in joint session, do hereby enact the following legislation to further the ideals of Peace, Strength and Prosperity.
Article I - Dissolution
The Assembly of Governors and Provinces are hereby dissolved. The provinces shall be merged as described below. The citizens of the provinces shall decide which laws and charters to incorporate into the new provinces. All treaties and federal laws are to remain enacted.
Article II - Government Structure
The People’s Republic shall consist of a Foreign Cadre which will protect the realm from threats beyond and within the boarders, as well as a Domestic Cadre which will handle the internal affairs of the state and contribute to the industry and harmony of the Pacific. The Foreign Cadre shall be known as the Senate, while the Domestic Cadre shall be known as the Assembly. The justice and jurisprudence of the Pacific shall be handled by a Judicial Cadre, henceforth known as the Department of Justice.
Article III - Senate Offices
The senate will remain an autonomous branch concerned with the foreign affairs and security of the Republic. As such, the position of Senator of Internal Affairs shall be eliminated. All senate offices are headed by their respective senator, and each senate office, and only senate offices, shall be referred to as departments (such as the Department of Diplomacy). Senate Departments shall be:
Senator of the Delegacy: The delegate shall be the advance guard of the Revolution and protector of the realm. The delegate shall be in charge of all business in the senate shall have the power of pardon.
Senator of Intelligence: The Senator shall head the Pacific Bureau of Intelligence. The Senator shall protect the Republic, investigate threats, and work with our allies and friends. The Senator shall be the co-director of the Bureau of Immigration and Naturalization (BIN).
Senator of Security: The Senator shall protect the realm from domestic threats, processing background checks, and keeping the Republic secure. The senator shall head the Praetorian Guard, and is co-director of the Bureau of Immigration and Naturalization (BIN).
Senator of Diplomacy: The Senator shall be the chief diplomat and head the diplomatic corp. The Senator shall negotiate treaties and maintain the embassies.
Senator of Economics: The Senator shall oversee the industrialization of the Pacific and ensure that the fruits of the People’s Labors go toward the betterment of Pacific Society and are not siphoned away by Userites.
Senator of Media Affairs: The Senator shall head the Pacific News Network and shall be the official spokesperson for the Republic.
Senator of Justice: The Senator shall head the Department of Justice, and be the final word of jurisprudence in the Pacific. Shall maintain the offices of the JAG and the Public Defenders.
Senator of Administration: The Senator shall maintain forum decorum, forum maintenance, be a liaison to the Governors and the Ministers and support their efforts with the full power of the Senate.
Article IV - Provincial Offices and Ministries
The Republic shall have four provinces, which shall be drawn by the Senate and the Assembly to be roughly equal in size. Each province shall be charged with maintaining one ministry of government. Each province shall send two representatives to the Assembly: the Governor of the Province and the Minister who shall head said provinces’ ministry. All ministers and governors stand for election every four months.
Province 1 (#-D): Finance - As the Chancellor of the Exchequer, the Minister of Finance shall head the GosBank and value the Franco, securing our place in world trade
Province 2: (E-L) Militia Affairs – Shall be the commander of the People’s Militia, and shall train in times of peace and mobilize in times of war.
Province 3: (M-R) Gaming - The Minister of Gaming shall provide for out of character conversations, diversions for the Pacific populace, and maintain activity in the Pacific Role-playing Society.
Province 4: (S-Z) Culture – Shall head the Ministry of Culture and be the cultural organ of the Republic. The minister shall maintain the literature and images of the revolution, while creating the fabric that is our society, as well as maintaining the Pacific Historical Society, the Pacific University and the Office of Cartography.
Governor: Each province shall have a governor who will represent the province in the Assembly, and be the executive of the province.
Lt. Governor: Each province shall have a Lt. Governor and the officer shall handle all citizen affairs for their province (recruiting and processing citizen applications), but each citizenship granted must have the approval of the Senator of Intelligence and Senator of Security. The full senate handles appeals on citizenship.
Judge Advocate General (JAG): Each province shall have a JAG who will decide which alleged violators of the judicial code warrant prosecution. Only the JAG or a senator may bring forth charges.
Provincial Officers: Each province has the right to create any system of government they so desire, as long as the above four positions are filled. However, no Provincial officer may have the title of a Federal Officer (such as director, minister, or senator).
Article V - Bureaus
The Pacific may need government offices that are independent of the direct management of a single member of the Senate or Assembly. In such a case, the government office shall be called a Bureau, and its chief officer(s) the Director(s). A prime example is the Pacific University (run by the Bureau of Academia) and headed by the Director of Academia. Directors shall be installed according to Pacific law at the time the Bureau was created.
Article VI - Citizenship
Only citizens of the Republic may vote, hold federal office, or participate in the Palace of the People.
Citizenship is defined by the following: Any nation which has registered on the forum, has requested citizenship, is a member of the United Nations (UN), and is endorsing the Delegate. Nations which are on official business of the Republic are exempt from having their UN nation endorsing the Pacific delegate as a requirement for citizenship for the duration of the business.
Nations which fail to meet the definitional requirements for citizenship may apply for dual citizenship through the Bureau of Immigration and Naturalization (BIN). The BIN is headed by the Senators of Intelligence and Security. Each province shall have a field office of the BIN, to be headed by the Lt. Governor. The Lt. Governor processes applications, and final approval for citizenship must be granted by both Director/Senators. All citizenship appeals are handled by the full senate.
The BIN shall accept applications and process them in order that the applications are received. The application must contain the residence of the UN nation, the name of the Pacific puppet nation(s), and it must match the registered forum name. The nation requesting dual citizenship must make a statement explaining the reason for attaining dual citizenship. The nation is also required to take an oath declaring loyalty to the Republic. The UN nation and its location will be kept in the strictest of confidence. Only the Lt. Governor receiving the application, the Senate, and Director of Justice has access to BIN applications.
Dual citizenship may be revoked by the Director of Justice via trial, the Directors of the BIN, or the Delegate. Reasons for revocation of citizenship status include, but are not limited to: 1) Attempting to infiltrate the Republic for another government or organization; 2) Commission of a felony under the Judicial Code; 3) Treason.
All citizens of the Republic shall have access to the People’s Palace. Non-citizens may not speak in the People’s Palace and may be denied access to the People’s Palace at the discretion of the Delegate or Censor.
No grandfather clause is included in this legislation. All non-citizens who wish to attain dual citizenship must immediately apply for status.
Article VII - Technical Corrections
All current statutes that make references to the Senate, Delegate, Provinces, Officers or Assembly of Governors shall be amended to refer to their proper Bureau, Office, Department, Ministry, or Officer. All current Federal Laws are amended to be consistent with this legislation.
