====Title 1: Basic Rights====

Every Citizen of the Pacific is entitled to several basic rights when accused of a crime. They are entitled to a fair and speedy trial. They are entitled to legal representation. They are entitled to due process as set forth in the judicial code. They are entitled to notification of their crimes, their accusers, and their Title 1 rights.

====Title 2: Due Process====

When accusing a nation, please inform your District Attorney, as they are the only ones who may bring charges forth charges. Should the accused be convicted, you will be credited with the conviction toward your Praetorian Guard status.

Upon receiving notification of a Penal Code violation, the District Attorney will present all evidence to the civil court. There, the presiding judge will determine if there is enough evidence for a trial. If there is, the offending nation will be given one week to appear in the high court and face his accusers unless it is a Title 3, section 1 violation. If the accused fails to appear, a verdict of guilty shall be rendered. If the accused appears, a trial date will be set, the accused will be assigned a lawyer, and the high judge will decide the verdict.

The delegate has the ability to pardon any guilty party of their crimes.

The administration of justice must be seen as an important ideal in the maintenance of law and order in The People’s Republic of the Pacific. The duty of any government is the protection of its people, and as such, the Judicial Code is a tool for the protection of the sovereign people of the Pacific.

The purpose of this document is to define the administration of justice in The People’s Republic of the Pacific (Hereafter referred to as “The Republic” or “The Pacific”). Specifically, this document shall instruct the citizens how the justice system operates. This document shall also define the laws of the Pacific. This version of the Judicial Code supercedes any previous versions.

====Title 1: Basic Rights====

Any citizen of the Pacific who is accused of a violation of the judicial code is guaranteed several basic rights.

1) All accused parties are entitled to official notification of their crimes.
2) All accused parties are entitled to a fair and speedy trial
3) All accused parties are entitled to legal representation. The legal representation may be appointed for the accused, or the accused may seek his/her own representation, or the accused may represent his/her self.
4) All accused parties are entitled to due process as forth in this judicial code.
5) All accused parties are entitled to official notification of their rights.

====Title 2: Due Process====

Due process of law is defined as the due course of legal proceedings according to the rules and forms which have been established for the protection of private rights and for The Republic. It also accounts for the formal adherence to fundamental rules for fair and orderly legal proceedings.

Legal proceedings in the Republic shall abide by the following format.

1) All alleged violations of the Judicial Code shall be brought forth to the High Court by the District Attorney from the Province in which either the violation allegedly occurred or where the Accused resides. District Attorneys shall only send alleged violations to the High Court in which there is evidence that probable cause exists for the Accused to be tried.
2) Nations that assist District Attorneys in reporting violations of the Judicial Code shall be awarded credit toward attainment of Praetorian Guard status.
3) Upon receiving notification of a Penal Code violation, the District Attorney will present all evidence to the civil court. There, the presiding judge will determine if there is enough evidence for a trial. If there is, the offending nation will be given one week to appear in the high court and face his accusers unless it is a Title 3, section 1 violation.
4) If the accused fails to appear, a verdict of guilty shall be rendered. If the accused appears, a trial date will be set, the accused will be assigned a lawyer, and the high judge will decide the verdict.
5) The Accused may request an appeal. The High Judge must then set up an appeals panel to hear the case. The appeals panel can comprise of two inferior judges and one Senator and one member of the Assembly, or it may comprise one disinterested citizen and one Senator and one member of the Assembly.
6) Once the verdict is decided and all appeals exhausted, the High Judge shall make a recommendation to the Delegate as to the sentence. The Delegate may decide to do any of the following: a) Administer the sentence as recommended; b) Reduce the sentence; c) Conduct a private sentencing hearing before deciding on a sentence; d) Award clemency
7) It is the responsibility of the High Judge to notify nations of their infractions. If the Delegate ejects nations for emergencies, the Delegate will forward the list of ejected nations to the High Judge for notification purposes.

====Title 3: Sentencing====

Sentencing. All parties who have been found guilty of their crimes shall be sentenced as provided in the Judicial Code. A recommended sentence by the High Judge shall be forwarded to the Delegate. However, the Delegate may elect to use mitigating and aggravating evidence as a means to alter the sentence.

Mitigating factors are defined as circumstances surrounding the commission of a crime that do not in law justify or excuse the act, but which fairness may be considered as reducing the blameworthiness of the defendant. Aggravating factors are defined as circumstances relating to the commission of a crime that cause its gravity to be greater than that of the average instance of the given type of offense.

The Delegate may elect to banish a guilty party for a determinate amount of time. The Delegate may also elect to place a nation in a probationary status, to which the probationary nation will have to make arrangements with the High Court to establish proper supervision of the sentence. A nation that is in probation status must adhere strictly to the Delegate’s guidelines; any violation of the probation may result in the immediate administration of the original sentence. The Delegate also reserves the right to pardon convicted nations. Any nation convicted of crimes may petition for pardon after all appeals have been exhausted.

====Title 4: Penal Code====

Nations that are accused of crimes within this section may be presumed innocent until proven guilty, however they may be placed in the Rejected Realms Penal Colony for the security of the Republic and her citizens. The burden of proof shall be placed upon the Republic to show beyond a reasonable doubt that the Accused is indeed guilty of the infraction. If the trial determines that the Accused is guilty of the infraction, execution of the sentence may be made immediately. If the trial determines that the Accused is not guilty of the infraction, the Accused shall be immediately released from the Penal Colony, and permitted reentry in The Pacific. All cases within this section are heard within the Superior Court of the Pacific.

This possession can take place in one of two areas: either in the NS environment or in the PRP forum. The term objectionable is defined as: Any graphic or word which may elicit outrage or disgust by any reasonable person. These can be in the form of pornographic, obscene, or any form which may be construed as disparaging. The Delegate of the Pacific shall provide guidance as to what may be considered objectionable.

'''Sentencing Guideline''': Any nation accused and found guilty of this crime may be banned for a period of 45 days from the Pacific. The nation must take corrective action to be re-admitted. A second infraction of this crime may lead to permanent banishment.

====Title 5: Laws of the Republic====

All laws developed by legislature are enforceable. All legislature is considered to be law. Legislation may be used to update and add to the judicial code.

====Title 6: Amendments====

This Judicial Code may be amended by majority vote by the Senate and the Assembly. The delegate reserves the right of veto. If the amendment is vetoed, the Assembly and/or the Senate reserves the right to call for a public referendum. If the public referendum achieves a 75% vote in favor, then the amendment is automatically placed into the Judicial Code.

If either the Assembly or the Senate fails to approve the amendment, then a public referendum may be called by either the Assembly or the Senate. Again, if the public referendum achieves a 75% vote in favor, then the amendment is automatically placed into the Judicial Code.

====Title 7: Final Statement====

No nation may be tried retroactively based on the laws set forth in this Judicial Code. All nations in violation of the Judicial Code from the date that this code is placed into effect may thus be tried.

This Judicial Code is now in effect as of 27 June 2005.
